Terms of Service

These Terms of Service ("Terms") govern your use of the 37.DEV website located at 37dev.com (the "Site") and any services offered by 37.DEV ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance and updates

These Terms apply to all visitors and users of the Site. We reserve the right to modify these Terms at any time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

2. Services described

37.DEV offers three services:

• 37.WEB — a subscription website service: design, build, hosting, and ongoing updates for a flat monthly fee (see /website-services). Plan pricing, any initial-term commitment, the free-rebuild offer, and cancellation terms are stated on that page and confirmed in your order or Service Agreement, which governs the engagement.
• 37.OS — an AI operating system for service businesses, which includes Add-on Agents organized into five suites (Admin, Creative, Marketing, Ops, and Sales).
• Custom AI & Dev — scoped, fixed-price engagements via /ai-dev-consulting.

The Site facilitates initial contact, AI Adoption Audit requests, and general inquiries. Specific terms governing any client engagement are set out in a separate Statement of Work or Service Agreement; where this Site and a signed agreement differ, the signed agreement controls.

The Site does not provide legal, medical, or financial advice. Any content on the Site is for general informational purposes only.

3. User obligations

When using the Site or contacting us through any channel, you agree to:

• Provide accurate and truthful information in all forms and inquiries.
• Not use the Site to transmit spam, malware, or any unlawful content.
• Not attempt to disrupt or interfere with the Site's operation or infrastructure.
• Not misrepresent your identity or your business.

4. Free AI Adoption Audit

The AI Adoption Audit is offered at no charge and with no obligation to engage 37.DEV's services. The Scorecard and report are yours to keep regardless of whether you become a client. 37.DEV reserves the right to decline or discontinue an Audit at its sole discretion.

5. Intellectual property

All content on the Site, including text, graphics, logos, the 37.OS product, the agent-suite methodologies, and the ACORN runtime framework, is the intellectual property of 37.DEV and may not be reproduced, distributed, or used without prior written authorization. The "37.OS" name and product, and the "ACORN" name and runtime framework, are proprietary to 37.DEV.

6. Limitation of liability

To the maximum extent permitted by applicable law, 37.DEV's total liability for any claim arising out of or relating to the Site or these Terms shall not exceed the amounts paid by you to 37.DEV in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

7. Third-party links and services

The Site may contain links to third-party websites or integrate third-party tools (such as our chat widget or scheduling system). These services operate independently under their own terms and privacy policies. 37.DEV is not responsible for their content, availability, or practices.

8. SMS communications

If you provide your phone number and opt in to SMS communications, you may receive messages related to your Audit, proposals, or engagement. Message frequency varies. You can opt out at any time by replying STOP. Message and data rates may apply.

9. Disclaimer of warranties

The Site and its content are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Denver County, Colorado.
